The Constitutional Barrier to Dual Citizens in Politics

Dual citizenship in Bangladesh is a complex intersection of immigration law and constitutional politics. While the government encourages the diaspora to maintain ties through the Dual Nationality Certificate (DNC), the Constitution of Bangladesh places a strict firewall between dual citizenship and political power.

Under Article 66(2)(c) of the Constitution of Bangladesh, a person is explicitly disqualified from being elected as, or from being, a Member of Parliament (MP) if they acquire the citizenship of, or affirm or acknowledge allegiance to, a foreign state.

The 2024-2026 Election Controversies

The constitutional restriction has become a major political flashpoint in recent elections. The Bangladesh Election Commission (BEC) routinely scrutinizes the nomination papers of candidates to verify their citizenship status.

The controversy centers on the interpretation of “renunciation.” Does a candidate merely need to submit an application to renounce their foreign citizenship before filing nomination papers, or must the foreign government formally approve the renunciation first? For instance, in the UK or the US, renunciation is a lengthy legal process that is not finalized until a formal certificate of loss of nationality is issued.

In recent election cycles, candidacies have been both cancelled and controversially upheld based on differing interpretations of when a foreign citizenship is legally considered “relinquished.” This has led to accusations of bias and extensive litigation in the Supreme Court’s Appellate Division.

If you hold a Dual Nationality Certificate (DNC), you enjoy almost all the rights of a standard Bangladeshi citizen, with the notable exception of running for parliamentary office or holding certain sensitive constitutional posts. You can:
